Here at Marketing Launch Innovations, we aim to meet your needs by providing a blend of value and experience. Our pricing is set by the hour and anything requested / provided out of scope will be billed extra.

Project Timeline

We will endeavor to meet specified deadlines laid out in the Quote provided. Please make every effort to submit content required and approvals by agreed upon deadlines. Marketing Launch Innovations will not be responsible if the target date cannot be met due to late submission of materials by the Client.

Payment Schedule

The payment schedule will be outlined in the Quote/scope sent by email to the Client. We are confident that you understand that any invoices sent to you should be paid promptly, and payment is due within 14 days on the presentation of each invoice you will receive.

Late or delayed payments will incur a Late Fee of 2.5%, and may also compromise the project timeline.

If you are hosting the site on another server (that is not hosting with Marketing Launch Innovations or via a partner), payment must be made in full before any files will be released or uploaded to your servers. This is non-negotiable.

Traffic

We have no control over the number of visitors to your site. Please be aware that simply building a website is not enough to generate traffic. Please speak to us if you wish to learn more about traffic generation.

Workflow & Efficiency

Web Development: Stages of a project define the prerequisites for subsequent work. In order to prevent unnecessary work, costs, or delay of project completion, Marketing Launch Innovations will provide material for review and approval during the creation process. Projects will be broken down into sets of tasks, referred to as stages. Stages may be implemented concurrently.

• Marketing Launch Innovations will not begin processing provided materials until they are finalized by the client.
• Once materials are green-lighted, Marketing Launch Innovations with begin implementation
• Once a stage is ready for review, Marketing Launch Innovations will present the work to the client, either as part of an overall demo or a unit test.
• The client will review the work to check for adherence and provide approval.
• Once a stage is approved, we will continue to the next stage.

Web Develpment / SEO/Content

• Any modifications, deviations, or additions to designs, materials, content, functionality, or navigation, after an approval will be billed hourly if it results in back-fixes or extra work. Additionally phone conversations / questions / consulting are considered time to be billed hourly.

Approval Process - Web Design

During the project development process, Marketing Launch Innovations provides regular design and project updates. While Marketing Launch Innovations performs its own testing of the entire website and functionality, the final responsibility lies with the customer to ensure that the modules and the complete project has been tested for any deficiencies or errors and to confirm that the site is operating as originally intended.

It is expected that the customer responds with any feedback and corrections within the timelines specified with every update, to ensure that the project can be completed on time. If the customer does not respond within seven business days (unless pre-agreed) of delivery of the website's final version, it will be assumed that the work is accepted and the completion of the project approved. Any further changes must be requested in the form of maintenance for the existing website.

Changes to Scope & Additional Services - SEO/Web Design / Content

Any revisions, additions or redesign requests outside of the original scope and hours budgeted will be considered "additional".

We are not in the business of providing free updates if it is not specified in the rate, scope of work, or contract. Requests made out of scope are subject to change and may be higher than the hourly rate specified in the scope of work. If the client wants any changes that are not specified in their documentation/scope of work, then we will charge extra for it. Additionally phone conversations / questions / consulting will be charged and billed hourly as they relate to the customer strategy.

Maintenance

This Agreement does not provide website maintenance unless a website maintenance plan is purchased. This Agreement does not provide IT work unless a IT plan is purchased. Hourly rates for this type of work may be different.

Staging Environment

Sometimes, Marketing Launch Innovations uses a three-tier roll out structure. We develop internally on our own development servers and then present the work in progress to you on our own "staging" servers to allow you to review and request changes prior to launch.

Staging Environment is included for projects during active development. After 6 months, if development is no longer active, the demo site will be removed from our Staging server.

Refund Policy

A consolidated brief must be submitted for all projects, containing all requested information before the project will commence. If the customer fails to submit the required information within 30 days of making the payment, Marketing Launch Innovations may decide to consider the project inactive and not proceed with its implementation.

If an order is cancelled within 7 days of making the payment and before any work has been done, we will refund 75% of the payment. If the work has already begun the maximum refund will be 50% of the payment. There will be no refund if more than 50% of the work has been completed.

The client must advise of sections with which they are unhappy, and if they require a refund, this must be requested within 30 days of work completion.

Marketing Launch Innovations reserves the right to negotiate and refund an appropriate portion of the amount paid by the customer under special circumstances. If a refund is demanded, work done on the site must be taken down (for the hours worked on) for liability reasons. We reserve the right to re-sell any work the client does not wish to compensate for, including blogs, special informational pages etc.

Marketing Launch Innovations is not liable for any damages that arise from misinformation or misrepresentation under any circumstances.

When work is approved and signed off on the website, or paid for, our business is concluded for that section of work. The client has 30 days post completion of that portion of work if they require a refund for that portion of work - or do not wish to pay. Refunds must be requested within 30 days of concluding work. If the client is unhappy with the work, or requests a refund due to the project being over budget, then we will remove all of the work from site for disputed hours.

Confidentiality

Marketing Launch Innovations will not disclose  any confidential information obtained from client in the course of completing the contracted work to third parties.

Ownership and Copyright

The Client represents that all website content including logos, trademarks, photos, illustrations, audio, video, and written content provided to Marketing Launch Innovations are owned by the Client, or the Client has received explicit permission for use, and do not violate Canadian copyright law. Marketing Launch Innovations is not responsible or liable for any copyright or trademark claims regarding third party logos, images, trademarks or names used on the website.

Upon final payment and approval of the completed project, our client becomes the owner of the website and can take the website / web application to another developer or web host. If any refunds were made, or the client was unhappy with the work, that work must be taken down off the website for liability reasons.

The client agrees that Marketing Launch Innovations may use the created website in its portfolio to showcase completed work to prospective customers and for its own marketing purposes.

Warranty

Each project includes a warranty for 6 months after going live should any features not function as required. This warranty does not cover links that change over time, pages that become obsolete over time, content that becomes outdated over time, or other changes that do not result from any error on the part of Marketing Launch Innovations.
